3. AI-Generated Content Disclaimer

  • You are responsible for reviewing and monitoring AI interactions where necessary

  • Tram AI is not liable for decisions made based on AI-generated content

4. Call Recording & Communication Consent

By using our services, you acknowledge and agree that:

  • Calls, messages, and interactions may be recorded, transcribed, and processed by AI systems

  • You are responsible for informing your customers or users of such recording where required by law

  • You will obtain any necessary consents under applicable laws (including Canadian privacy laws)

5. Third-Party Services

Our services rely on third-party providers, including but not limited to:

  • Make (automation)

  • Twilio (communications)

  • Vapi (voice AI)

  • OpenAI and Anthropic (AI processing)

  • Google (analytics and infrastructure)

We are not responsible for:

  • Service interruptions caused by third-party providers

  • Data handling practices of third parties

  • Changes to third-party pricing, policies, or availability

6. Payment & Fees

  • Fees for services will be agreed upon prior to engagement

  • Payments are due as outlined in your invoice or agreement

  • All fees are non-refundable unless otherwise stated in writing

We reserve the right to suspend services for non-payment.

7. No Guarantees

While we aim to improve your business efficiency and performance:

  • We do not guarantee specific results, revenue increases, or business outcomes

  • Performance may vary based on your business, industry, and implementation

8. Limitation of Liability

To the fullest extent permitted by law:

Tram AI shall not be liable for:

  • Indirect, incidental, or consequential damages

  • Loss of revenue, profits, or business opportunities

  • Errors or inaccuracies in AI-generated outputs

  • Service interruptions or downtime

Our total liability shall not exceed the amount paid by you for services in the preceding 30 days.

9. Indemnification

You agree to indemnify and hold harmless Tram AI from any claims, damages, or liabilities arising from:

  • Your use of our services

  • Your violation of these Terms

  • Your failure to comply with applicable laws or obtain required consents

10. Data & Privacy

Your use of our services is also governed by our Privacy Policy.

You acknowledge that:

  • You are responsible for ensuring your use complies with applicable privacy laws

11. Termination

We may suspend or terminate your access to services at any time if:

  • You violate these Terms

  • Payment is not received

  • Continued service poses risk to our business

You may terminate services at any time, subject to any agreed notice period.

All content, systems, and materials provided by Tram AI remain our property unless otherwise agreed.

You may not:

  • Copy, resell, or redistribute our systems without permission

  • Reverse-engineer or attempt to replicate our solutions

14. Governing Law

These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein.
